Terms of Use

This Terms of Use (this “Agreement”) is between You and The French-American Chamber of Commerce of the Carolinas (“FACC Carolinas”). This Agreement sets forth the terms and conditions governing Your use of FACC Carolinas’ website, currently located at  (the “Site”), and Your use of FACC Carolinas’ services (collectively, the “Service”), including the purchase of memberships and event tickets via our Wix website. BY USING THE SITE, PURCHASING A MEMBERSHIP, OR REGISTERING FOR AN EVENT, YOU ACCEPT ALL TERMS AND CONDITIONS IN THIS AGREEMENT. If You do not accept these terms, do not use the Site or Service.

FACC Carolinas may update this Agreement periodically. Your continued use of the Site or Service after such updates constitutes acceptance of the modified Agreement. FACC Carolinas reserves the right to modify or discontinue features of the Site or Service at any time. “You” and “Your” refer to all users of the Site and Service.

1. Use of Service The Site and Service provide resources for FACC Carolinas members and visitors, including information on networking events, membership benefits, and content such as newsletters and event listings. Some services, like member discounts, are exclusively for FACC Carolinas Members.

As a condition of Your use, You agree not to:

  • Use other members’ personal information for purposes other than FACC Carolinas’ networking objectives.

  • Restrict or inhibit any other user from enjoying the Service.

  • Post or transmit any unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable content.

  • Post or transmit any material that infringes on the rights of others, contains viruses, or is for unauthorized commercial purposes.

 

FACC Carolinas reserves the right to monitor Your use, disclose information as required by law, edit or remove objectionable content, and deny access to users who violate this Agreement or interfere with the Service.

2. Your Content Any information or materials You provide to FACC Carolinas (“Your Content”) grants FACC Carolinas a non-exclusive, royalty-free license to use, reproduce, and display Your Content for non-commercial purposes related to FACC Carolinas activities. You are solely responsible for Your Content, and FACC Carolinas may take action if Your Content creates a risk of liability.

3. Copyright If You believe any content on the Site infringes Your copyright, please provide FACC Carolinas’ Copyright Agent with a written notice including: an electronic or physical signature of the owner; identification of the copyrighted work; a description of where the infringing material is located on the Site; Your contact information; a statement of good faith belief that the use is unauthorized; and a statement, under penalty of perjury, that the information in Your notice is accurate and You are the copyright owner or authorized to act on their behalf. Contact information for FACC Carolinas’ Copyright Agent is provided in Section 7 below.

4. Memberships and Event Tickets

  • Memberships: Membership to FACC Carolinas is typically renewed annually unless canceled. Details regarding membership benefits, duration, and cancellation procedures are available on the Site or by contacting FACC Carolinas.

  • Event Tickets: All event ticket sales are subject to a refund policy determined on a case-by-case basis at the sole discretion of FACC Carolinas. Requests for refunds must be submitted in writing to .

5. Limitation of Liability Under no circumstances shall FACC Carolinas be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, the Site or Service. You agree that FACC Carolinas is not liable for any defamatory, offensive, or illegal conduct of any user. Your sole remedy for dissatisfaction with the Site or Service is to discontinue its use.

6. Disclaimers The Site may contain links to third-party sites. FACC Carolinas does not operate or control in any respect any information, products, or services on these third-party sites. The materials in this Site and the third-party sites, including without limitation all advice, research and other information, are provided for informational purposes only and are provided “as is” and without warranties of any kind either express or implied, and FACC Carolinas shall not be liable for Your reliance thereon. To the fullest extent permissible pursuant to applicable law, FACC Carolinas disclaims all warranties, express or implied, with respect to the Site, Service and otherwise, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. FACC Carolinas does not warrant that the functions contained in the Site will be uninterrupted or error-free, that defects will be corrected, or that this Site, including bulletin boards, or the server that makes it available, are free of viruses or other harmful components. FACC Carolinas does not warrant or make any representations regarding the use or the results of the use of the materials in this Site or in third-party sites in terms of their correctness, accuracy, timeliness, reliability or otherwise.

7. General This Agreement is governed by the laws of the State of North Carolina, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this Agreement shall lie exclusively with the state or federal courts within Wake County, North Carolina. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in additional terms of use provided by FACC Carolinas for areas of the Site, a particular “Legal Notice,” or other notices provided by FACC Carolinas on particular Web pages, this Agreement constitutes the entire agreement between You and FACC Carolinas with respect to the use of the Site.

8. Tax Deductibility of Dues, Fees & Contributions The French-American Chamber of Commerce of the Carolinas is not a charitable organization and therefore any gift, contribution, dues payment or fees should be considered a general business expense.
